PROMOTION DESCRIPTION:
The GIGABYTE COMPUTEX 2023 Sweepstake (the "Sweepstake") is hosted by GIGA-BYTE TECHNOLOGY CO., LTD, No.6, Baoqiang Rd., Xindian Dist., New Taipei City 231, Taiwan (the "Host"). By participating in the Sweepstake, each entrant unconditionally accepts and agrees to comply with and abide by these Terms and Conditions, the Rules, and the decisions of the Host, which shall be final and binding in all respects. The Host is responsible for the collection, submission or processing of the entries and the overall administration of the Sweepstake. In case of any questions, comments or problems related to the Sweepstake, the Entrants should approach solely the Host. The Host may be reached by email at esupport.gigabyte.com during the Promotion Period.

ELIGIBILITY:
The Sweepstake is open to legal residents 18 years or older in Singapore, Malaysia, Philippines, Indonesia, Vietnam, Thailand, New Zealand, Australia, Taiwan, South Korea, Myanmar.

The Host, and their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies and each of their respective officers, directors and employees (the "Promotion Entities"), are not eligible to enter the Sweepstake or win a prize. Household Members and Immediate Family Members of such individuals are also not eligible to enter or win. "Household Members" shall mean those people who share the same residence for at least three months a year. "Immediate Family Members" shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. This Sweepstake is subject to all applicable federal, state and local laws and regulations and is void where prohibited or restricted by law. GIGABYTE reserves the right to cancel or withdraw all awards and prize entitlements if any content submitted by the entrants is not their own original creation.

PRIZES:
A total of 2 unique winners worldwide will be awarded in 2 different sweepstakes: GIGABYTE COMPUTEX 2023 Graphics Card event & GIGABYTE COMPUTEX 2023 Laptop event.

Prizes cannot be transferred, redeemed for cash or substituted by the winners. The Host reserves the right in its sole and absolute discretion to award a substitute prize of equal or greater value if a prize described in these Official Rules is unavailable or cannot be awarded, in whole or in part, for any reason. The prizes are not transferable or eligible for a standard manufacturer warranty. The ARV of the prize represents the Host's good faith determination. That determination is final and binding and cannot be appealed. If the actual value of the prize turns out to be less than the stated ARV, the difference will not be awarded in cash. The Host makes no representation or warranty concerning the appearance, safety, or performance of any prize awarded. Restrictions, conditions, and limitations may apply. The Host will not replace any lost or stolen prize items.

All customs, VAT, federal, state and/or local taxes, fees, and surcharges are the sole responsibility of the prize winner. The Winner is advised to check and is responsible for any tax implications which may arise as a result of accepting prize(s).

Failure to comply with the Official Rules will result in forfeiture of the prize.

HOW TO ENTER:
The Sweepstakes is open for Entries during the promotion period from 29th May 2023 to 11:59 PM 2nd June 2023 (UTC+8). 
The Winners will be determined on 9th June 2023.
The Winners of the Sweepstakes will be determined by a random draw by GIGABYTE from among all the eligible Entries received throughout the Promotion Period.

WINNER NOTIFICATION:
The Winners will be announced on the social media accounts of AORUS (Facebook, Twitter or Instagram). They will also be notified by private message or email provided in the Entry Information approximately 7 days after the winner announcement. The potential winner must accept the prize by email as directed by the Host within 2 weeks of notification. The Host is not responsible for any delay or failure to receive notification for any reason, including inactive email account(s), technical difficulties associated therewith, or the winner’s failure to adequately monitor any email account.

Any winner notification not responded to or returned as undeliverable may result in prize forfeiture. The potential prize winner may be required to sign and return an affidavit of eligibility and release of liability, and a Publicity Release (collectively "the Prize Claim Documents"). No substitution or transfer of a prize is permitted except by the Host.

The winner agrees to the use of his/her name, image and entry in any publicity material. Any personal data relating to the winner or any other entrants will be used solely in accordance with the current data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.

Entry into the Sweepstake will be deemed as acceptance of these terms and conditions.

The Host (GIGABYTE) shall have the right, at its sole discretion and at any time, to change or modify these terms and conditions. Such change(s) shall be effective immediately upon posting on this webpage.

OWNERSHIP/USE OF ENTRIES:
By submitting an entry, each entrant agrees Host shall have a perpetual, irrevocable, assignable, royalty-free, fully paid-up license to exploit, edit, modify, post, disseminate, create derivative works of, distribute and otherwise use the entry and all elements of such entry, including, without limitation, the names and likenesses of any persons or locations embodied therein, in any and all media now known or hereafter devised (including, without limitation, on Host’s websites), in perpetuity without compensation or notification to, or permission from, entrant or any third party.

By entering this Sweepstake, you represent and warrant that your entries do not infringe any copyright, trademark, property rights, rights of privacy or publicity of any person, or any other right of any third party and that you have the full and unrestricted right to transfer the materials to GIGABYTE free and clear of any claims or encumbrances.

PRIVACY:
Any personal information supplied by the entrant will be subject to the privacy policy of the Host posted at http://www.aorus.com/rule-pravicy.php. By entering the Sweepstake, the entrant grants the Host permission to share your email address and any other personally identifiable information with the other Sweepstakes entities for the purpose of administration and prize fulfillment, including use in a publicly available winners list.

LIMITATION OF LIABILITY:
The Host assumes no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Sweepstake; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilized in any aspect of the operation of the Sweepstake; (d) inaccessibility or unavailability of any network or wireless service, the Internet or website or any combination thereof; (e) suspended or discontinued Internet, wireless or landline phone service; or (f) any injury or damage to the entrant's or to any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in the Sweepstake or the download of any materials in the Sweepstake.

If, for any reason, the Sweepstake is not capable of running as planned for reasons which may include without limitation, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstake, the Host reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstake in whole or in part. In such event, the Host shall immediately suspend all drawings and prize awards, and Host reserves the right to award any remaining prizes (up to the total ARV as set forth in these Official Rules) in a manner deemed fair and equitable by the Host. The Host and Released Parties shall not have any further liability to any participant in connection with the Sweepstake.

GOVERNING LAW; DISPUTE RESOLUTION:
These terms and conditions, transactions and all matters relating to your access to or use of the Services, including any and all disputes, etc., contemplated hereby shall be governed by, construed and interpreted in accordance with, the laws of Taiwan R.O.C, without regard to its conflicts of law provisions. You agree to the personal jurisdiction by the courts of Taipei, and waive any objection to such jurisdiction. If any dispute arises from the use of these services, parties may make use of mediation. If the dispute cannot be resolved through mediation, they shall be free to pursue other legal options.

Nothing in these Terms and Conditions, including this Governing Law clause, affects your right to benefit from any mandatory provisions of the law of the state/ country in which you are resident.
